Supreme Court Rejects Bid To Overturn Same-Sex Marriage Ruling – Blavity

The Supreme Court has rejected a bid to overturn its 2015 ruling allowing same-sex marriage in the United States. The appeal was brought forward by former Kentucky court clerk Kim Davis, who refused to issue marriage licenses to same-sex couples. The court declined her appeal on Monday without comment.

Why was there a call to overturn same-sex marriage in the United States?

Davis said her faith prevented her from complying with the Supreme Court’s ruling in 2015’s Obergefell v. Hodges, which granted same-sex couples the right to get married and have their marriage recognized under federal law. She refused court orders telling her to issue the licenses, according to The Associated Press. In September 2015, a federal judge jailed Davis for contempt of court. She was then released after her staff removed her name from the license forms and issued them on her behalf. The Kentucky General Assembly then passed a law to remove the names of county clerks from state marriage licenses.

Davis also received an order from a lower court to pay $360,000 in damages and attorney’s fees to a couple whom she denied a marriage license. She was trying to overturn this order, which brought the case forth to the Supreme Court.

‘Love won again’

Justice Clarence Thomas has called for the erasure of the same-sex marriage ruling in the past, and he, Chief Justice John Roberts and Justice Samuel Alito all dissented to the 2015 ruling with the late Justice Antonin Scalia. According to the AP, Roberts hasn’t spoken on the subject since, and Alito, who has criticized the decision, “said recently he was not advocating that it be overturned.”

“Today, love won again,” Human Rights Campaign President Kelley Robinson said in a statement. “When public officials take an oath to serve their communities, that promise extends to everyone — including LGBTQ+ people. The Supreme Court made clear today that refusing to respect the constitutional rights of others does not come without consequences.”
